Terms of Service
Last updated: October 11, 2026
These terms cover the WorkGuard website at workguard.co.nz and the incident reporting and corrective action service at app.workguard.co.nz, including free trials and paid company workspaces. WorkGuard is operated by WORKGUARD LIMITED, a New Zealand limited company (company number 9459752; NZBN 9429053974402).
By creating an account or using the service, you agree to these terms. If you create or manage a workspace for an organisation, you must have authority to act for it. A separate written agreement with WorkGuard takes priority where it expressly differs from these terms.
The service and your safety responsibilities
WorkGuard helps your organisation record incidents and near misses, manage corrective actions, store supporting evidence, and review activity history. It supports your processes; it does not replace professional advice, emergency services, or your legal health and safety obligations.
You remain responsible for investigating incidents, managing hazards, checking records and completing actions. Recording an incident in WorkGuard does not notify a regulator or emergency service. Email notifications and reminders may be delayed or fail, so do not rely on them for urgent safety communications or statutory reporting deadlines.
Accounts and company workspaces
Keep account information accurate, protect your credentials, and tell us promptly if you suspect unauthorised access. Each user should use their own account. Your organisation is responsible for invitations, user roles, notification recipients, and removing access when it is no longer needed.
Your access depends on your role and the workspace's subscription and account status. Your organisation's administrators may manage your account and access to company records.
Free trials, plans, and user limits
New company workspaces receive a 14-day trial with up to 20 users. No payment card is required, and the trial does not automatically charge you or start a paid subscription.
Current standard plans are Starter at NZ$49 per month for up to 5 active users and Team at NZ$129 per month for up to 20 active users. Pending invitations reserve user places. Business plans have user limits and commercial terms agreed directly with WorkGuard.
Contact us to arrange paid access after your trial. Workspace access may become read-only when trial or paid access expires, or when account action is required. Expiry does not automatically delete your records. Reducing a plan may require deactivating users or cancelling pending invitations to fit the new allowance.
Invoices and payment
Subscriptions are invoiced manually. We confirm the plan, billing period, amount payable, applicable taxes, and payment due date when arranging your subscription. Paid access is updated after payment is received. WorkGuard does not automatically charge a payment card.
Contact us promptly about an invoice you believe is incorrect. Any change to an agreed price will be communicated before it applies to a future billing period; it will not change the price of a period already paid for.
Your records and privacy
Your organisation retains its rights in the records and files it provides. You give WorkGuard permission to host, process, transmit, and back up that content as needed to provide and secure the service, respond to authorised support requests, and meet legal obligations.
Only upload information you are entitled to provide. Your organisation is responsible for the accuracy and lawful handling of workplace records, including sensitive injury information, and for deciding who should receive access or notifications. Avoid recording unnecessary personal information.
Our Privacy Policy explains how we handle personal information, service providers, retention, and access or correction requests. You should keep copies of records required for your own legal or business purposes.
Acceptable use and intellectual property
Do not use WorkGuard unlawfully, upload malicious software, access another company's records without permission, interfere with the service, or attempt to bypass access controls or user limits.
WorkGuard and its licensors retain rights in the software, branding, and website content. We permit you to use the service for your organisation during your authorised access period. This does not transfer ownership of the software or permit resale of access without our agreement.
Availability, support, and changes
We aim to provide a reliable service and use reasonable care and skill. Maintenance, faults, and third-party outages may affect availability. We do not promise uninterrupted access or a particular support response time unless agreed in writing. Contact support for help.
We may improve or change features. If a change materially reduces the service you have paid for, we will give reasonable notice where practicable and discuss an appropriate remedy, including cancellation and a refund for an unused prepaid period where appropriate.
Cancellation, suspension, and workspace closure
An authorised company administrator can contact support to cancel future paid access or request workspace closure. We will confirm the end date and any outstanding agreed charges. Cancellation does not itself delete records. Contact us before access ends to arrange retrieval of records you need to keep; we will discuss the available options.
Refunds depend on the reason for cancellation, any separately agreed terms, and applicable law. These terms do not remove any right to a refund or other remedy provided by law.
We may restrict or suspend access for unpaid agreed charges, material breaches of these terms, security threats, or legal requirements. Where practicable, we will explain the issue and give a reasonable opportunity to resolve it. Urgent security or legal concerns may require immediate action.
Workspace deletion requests require review of authorisation and recordkeeping obligations. Backups and provider systems may retain copies for their applicable retention periods, as described in the Privacy Policy.
Liability and legal rights
Each party is responsible for its obligations under these terms and applicable law. To the extent permitted by law, neither party is liable to the other for indirect or consequential losses arising from the service. This exclusion does not apply to fraud or wilful misconduct, or to liability that cannot lawfully be excluded.
Nothing in these terms excludes, restricts, or modifies rights or remedies that cannot lawfully be excluded, including any applicable rights under New Zealand consumer law or the Australian Consumer Law. We do not automatically contract out of statutory protections because you use WorkGuard for business purposes.
Questions, disputes, and governing law
Please contact us first so we can try to resolve questions or disputes in good faith. These terms are governed by New Zealand law, subject to any mandatory protections that apply to you elsewhere. This does not prevent you from using a regulator, tribunal, or court available to you under applicable law.
Updates to these terms
We will post revised terms with a new date and give reasonable advance notice of material changes to affected customers where practicable. Changes will not retrospectively alter an agreed prepaid period. If you do not agree to a material change, contact us to discuss ending future use before the change applies.
